1. Your rights under the Australian Consumer Law
When you buy a Hippool as a consumer in Australia, the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) gives you a set of automatic rights called consumer guarantees. You get them by law. You don’t register for them, you don’t pay for them, and nothing we write anywhere — on this page, in our Terms, on the box — can take them away or make them smaller.
Among other things, the goods we sell you must:
- be of acceptable quality — safe, lasting, free from defects, acceptable in appearance and finish, and doing all the things a pool like this is normally used for;
- be fit for any purpose we told you about, or that you told us about before you bought;
- match the description we gave, and match any sample or demonstration model;
- come with clear title — they’re ours to sell, with no undisclosed security interest over them;
- be supported by repairs and spare parts being reasonably available for a reasonable time after purchase, unless we told you otherwise before you bought.
How long do these rights last? There is no fixed expiry date. The law asks a different question: how long would a reasonable person expect this product, at this price, described this way, to last? A pool that fails after one season is not the same case as a pool that fails after many. That’s why we don’t put a number on your legal rights — putting one there would be wrong, and it would work against you.
What happens when something goes wrong
- Major failure — the pool is substantially unfit for its normal purpose and can’t easily be fixed within a reasonable time; or it’s unsafe; or it’s very different from its description; or you wouldn’t have bought it had you known. Who decides the outcome: You choose. What you get: A refund, or a replacement — your choice. Plus compensation for any other reasonably foreseeable loss or damage caused by the failure.
- Minor failure — something’s wrong, but it can be put right within a reasonable time. Who decides the outcome: We choose the remedy. What you get: A repair, a replacement, or a refund. If we don’t fix it within a reasonable time, you can reject the goods and get a refund, or have it fixed elsewhere and recover the reasonable cost from us.
Getting a faulty pool back to us. If you’re entitled to reject the goods, you don’t have to arrange or pay for a return that isn’t reasonable to expect of you. Where the goods can’t be returned without significant cost because of their size, weight or nature — which is exactly the case for a Hippool box — collection is at our expense.
We never ask you for a receipt you can’t produce. Proof of purchase can be your order confirmation email, your bank statement, or your order number — whatever shows you bought it from us.
Who is responsible
Hippool pools are sold by BME Consulting, a société à responsabilité limitée (SARL) registered in Lyon, France, under company number 754 058 410. We are the supplier of your goods, and we say where we’re registered plainly rather than dressing it up. Selling to consumers in Australia means Australian Consumer Law applies to what we sell you — and we answer to it.
2. Pool safety in Australia
Pool fencing laws apply to this pool. Every Hippool holds water deeper than 300 mm, and in every Australian state and territory that’s the depth at which pool barrier laws are triggered — including for portable and inflatable pools.
- The legal duty to install and maintain a compliant barrier sits with the pool owner — that’s you — not with us. We’re telling you before you buy so it’s never a surprise after.
- Across the states and territories, requirements converge closely: a barrier of at least 1.2 m, a ground gap of no more than 100 mm, and a self-closing, self-latching gate. Several jurisdictions also require the pool to be registered and/or inspected.
- The exact rules, registration duties and timeframes are set by your state or territory. Check with your local council or state authority before you fill the pool.
Supervision is the thing that actually saves a child. Children have drowned in portable swimming pools. Keep active adult supervision at all times, keep children within arm’s reach, and never leave them unsupervised in or around the pool.
