In plain terms

  • The price you see is the price you pay. Prices are in Australian dollars and include GST. Delivery cost is shown before you pay, never after.
  • Australian Consumer Law rights apply to everything we sell you — and nothing in these terms takes them away. If a term of ours ever conflicted with your ACL rights, your ACL rights win.
  • Your order becomes a contract when we confirm we’re sending it — not the moment you click.
  • Pool fencing laws apply to this pool. Installing a compliant barrier is your responsibility as the owner. We say it here, before you buy.

We’re a French company selling to customers in Australia. We say that plainly, because you deserve to know who you’re contracting with — and because everything above is on a public register you can check.

It also means Australian Consumer Law applies to what we sell you here, and we answer to it. Buying from a company registered abroad doesn’t reduce your consumer guarantees by one line.


2. What these terms cover

These terms apply to every order you place with us through hippool.com as a consumer — that is, for personal, domestic or household use. They form the agreement between you and BME Consulting.

We may update these terms. The version that applies to your order is the one published when you placed it — we don’t change the deal after you’ve bought.


3. How your order becomes a contract

  1. You add products to your cart and place your order. That’s an offer to buy, and it’s the point at which payment is authorised.
  2. You get an order acknowledgement email. That confirms we received your order — it isn’t yet our acceptance.
  3. The contract is formed when we send you a dispatch confirmation (or, if earlier, when we tell you we accept your order).

We may decline an order — for example if the product is out of stock, if we can’t deliver to your address, if payment isn’t authorised, or if the price or product description was clearly and obviously wrong. If we decline, we tell you and refund you in full. We won’t quietly cancel and leave you guessing.


4. Prices, GST and what you actually pay

  • All prices are shown in Australian dollars (AUD) and include GST at
  • Delivery cost is displayed before you pay — on the product page and again at checkout. We do not add costs at the last screen.
  • The total you’re shown before you confirm payment is the total you pay. No handling fee, no surcharge, no surprise.
  • No customs duties, no import taxes on your doorstep. Your pool is sent from stock we already hold in Australia, imported and cleared through customs before you ordered it. Nobody will ask you for a payment when the parcel arrives. If anyone ever did, that would be our mistake to fix, not your bill to pay.

5. Paying

You can pay by card, with PayPal, or by bank transfer. Cards are processed through Shopify Payments. We don’t offer instalment or buy-now-pay-later plans — the price you see is paid once, in full, and there’s no credit product attached to your pool.


6. Delivery, title and risk

  • We deliver to addresses in.
  • Your order is sent from stock we already hold in Australia — not shipped to you from overseas after you order.
  • Delivery usually takes 5 to 7 days, to your home address. Delivery is charged, and the cost is shown before you pay. Full detail: Shipping & Returns. These are honest estimates — we don’t publish a number we can’t hold.
  • Risk passes to you when the goods are delivered to the address you gave us (or to someone at that address who accepts them on your behalf). Until then, they’re at our risk.
  • If nobody’s there and the carrier can’t leave the parcel safely, they’ll follow their own process.

It’s a big, heavy box. We say so up front so delivery day isn’t a shock — details in Shipping & Returns.


7. If something’s wrong with your order

Your Australian Consumer Law consumer guarantees apply, and they’re set out in full on our Warranty page. In short:

  • Major failure → you choose a refund or a replacement, plus compensation for any other reasonably foreseeable loss or damage.
  • Minor failure → we’ll repair it, replace it or refund you, within a reasonable time.
  • Damaged in transit, missing parts, wrong item → tell us, with a photo. See Shipping & Returns.

8. Our responsibility, and its limits

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any other law, where doing so would be void. If any part of these terms would have that effect, it doesn’t apply to you.

Subject to that:

  • We are responsible for loss or damage you suffer that is a reasonably foreseeable result of our breaking this contract or failing to use reasonable care and skill.
  • We are not responsible for loss that isn’t reasonably foreseeable, or for loss you suffer because you didn’t follow the setup, siting and care instructions we provide — in particular installing the pool on ground that isn’t level, firm and clear.
  • We do not limit our liability for death or personal injury caused by our negligence, for fraud, or in any other case where the law doesn’t allow it.

9. What we ask of you

  • Install and use the pool as our guides describe — level, firm, prepared ground; the stated capacity; the stated water depth.
  • Comply with the pool barrier laws that apply where you live. Every Hippool holds water deeper than 300 mm, which triggers pool fencing requirements in every Australian state and territory. That legal duty is on you as the owner. Check with your local council or state authority before you fill the pool. More detail: Warranty — Pool safety in Australia.
  • Supervise. Children have drowned in portable swimming pools. Active adult supervision at all times, children within arm’s reach.
  • Follow local water restrictions. They vary by area and they change — check yours before filling.
  • Use any electrical equipment supplied with the pool according to its instructions and Australian electrical safety requirements.

10. Things neither of us controls

If something genuinely outside our reasonable control delays or prevents delivery — extreme weather, carrier failure, port disruption, and the like — we’ll tell you as soon as we can and agree a new timeframe with you, or refund you if you’d rather not wait. We don’t use this clause to keep your money.


11. Your personal information

How we handle your data — what we collect, our legal basis for each use, who we share it with, how long we keep it and where it goes — is set out in our Privacy Policy. Cookies and tracking: Cookie Policy.

Because we’re a French company, European data protection law applies to your information wherever you live — including a right to a copy of it, a right to have it corrected or deleted, and a regulator you can complain to. It’s all in the Privacy Policy.


12. If we can’t sort it out

Talk to us first — contact@hippool.com, and we answer within 48 hours (Monday to Friday). Most things get fixed there.

If we can’t resolve it together, you can contact the consumer protection agency in your state or territory (Fair Trading / Consumer Affairs / Consumer and Business Services), or the Australian Competition and Consumer Commission (ACCC). You can also take a claim to your state or territory’s civil and administrative tribunal.


13. Which law applies, and where you can take a claim

Whatever this section ends up saying, your Australian Consumer Law rights apply. They cannot be displaced by a choice-of-law clause.
