In plain terms
- Covered by your province’s consumer protection law — your rights come first, and nothing in these terms takes them away.
- Prices in CAD, before tax — sales tax is calculated at checkout, based on your province. No import duties to pay on delivery: your pool is already here, already cleared through customs.
- Delivery usually takes 5 to 7 days, and we ship within 30 days of your order at the latest. If we haven’t delivered within 30 days of your order, and we haven’t agreed another delivery date with you, you can cancel and get a full refund.
- Your order becomes a contract when we confirm we’re sending it — not the moment you click.
- Pool safety rules apply where you live, and in Quebec they’re provincial. We tell you before you buy, not after.
1. Who you’re buying from

We’re a French company selling to customers in Canada. We say that plainly, because you deserve to know who you’re contracting with — and because everything above is on a public register you can check.
It doesn’t reduce your rights by one line. The consumer protection law of your province applies to what we sell you here, and we answer to it.
2. What these terms cover
These terms apply to every order you place with us through the Canadian pages of hippool.com as a consumer — that is, for personal, domestic or household use. They form the agreement between you and BME Consulting.
We may update these terms. The version that applies to your order is the one published when you placed it — we don’t change the deal after you’ve bought.
3. Which consumer protection law applies to you
Canada doesn’t have one consumer protection law — it has one per province and territory. Which one covers your purchase depends on where you are, not on where we are.
- Your provincial or territorial consumer protection law applies to this sale, and it applies whatever we write here. If anything in these terms conflicted with it, your rights win.
- Those rights aren’t something you can sign away, and we don’t ask you to.
- Quebec has its own regime, distinct from the rest of the country. If you’re in Quebec, that’s the one that covers you, and this contract exists in French — see §14.
- The detail — what remedy, for how long, in which order — varies by province.
4. How your order becomes a contract
- You add products to your cart and place your order. That’s an offer to buy, and it’s the point at which payment is authorized.
- You get an order acknowledgement email. That confirms we received your order — it isn’t yet our acceptance.
- The contract is formed when we send you a dispatch confirmation (or, if earlier, when we tell you we accept your order).
You get a copy of your contract. Your order confirmation email is your copy: it sets out what you ordered, what you paid, the delivery address and date, and the terms that apply. Keep it, or print it — it’s your record, and it’s your proof. If you didn’t receive it, tell us and we’ll send it again.
We may decline an order — for example if the product is out of stock, if we can’t deliver to your address, if payment isn’t authorized, or if the price or product description was clearly and obviously wrong. If we decline, we tell you and refund you in full.
5. Prices, taxes and what you actually pay
- Prices in CAD, before tax — sales tax is calculated at checkout, based on your province.
- Priced in Canadian dollars for Canada — not a converted price.
- No import duties, no customs charges on delivery. Your pool is sent from stock we already hold in Canada, imported and cleared before you ordered it. Nobody will ask you for a payment when the parcel arrives.
- Delivery cost is displayed before you pay — in your cart and again at checkout. We do not add costs at the last screen.
- The total you’re shown before you confirm payment is the total you pay. No handling fee, no surcharge, no surprise.
6. Paying
You can pay by card, with PayPal, or by bank transfer. Cards are processed through Shopify Payments. We don’t offer instalment or buy-now-pay-later plans — the price you see is paid once, in full, and there’s no credit product attached to your pool. We never store your full card details.
7. Delivery, title and risk
- We deliver to addresses in.
- Your order is sent from stock we already hold in Canada — not shipped to you from overseas after you order.
- Delivery usually takes 5 to 7 days, to your home address. Delivery is charged, and the cost is shown before you pay.
- Ships within 30 days of your order. Full detail: Shipping & Returns.
- Risk passes to you when the goods are delivered to the address you gave us (or to someone at that address who accepts them on your behalf). Until then, they’re at our risk.
- If nobody’s there and the carrier can’t leave the parcel safely, they’ll follow their own process.
8. If we’re late: your right to cancel
If we haven’t delivered within 30 days of your order, and we haven’t agreed another delivery date with you, you can cancel and get a full refund.
That’s not a favour: it’s what happens when we don’t hold up our end. The trigger is our delay, not a decision on your part. If we can see we’re going to be late, we tell you before the 30 days are up and agree a new date with you — or refund you, if you’d rather not wait.
9. If something’s wrong with your order
Your rights under your province’s consumer protection law apply, and they’re set out on our Warranty page.

10. Our responsibility, and its limits
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the consumer protection law of your province, or under any other law, where doing so would not be permitted. If any part of these terms would have that effect, it doesn’t apply to you.
Subject to that:
- We are responsible for loss or damage you suffer that is a reasonably foreseeable result of our breaking this contract or failing to use reasonable care and skill.
- We are not responsible for loss that isn’t reasonably foreseeable, or for loss you suffer because you didn’t follow the setup, siting and care instructions we provide — in particular installing the pool on ground that isn’t level, firm and clear.
- We do not limit our liability for death or personal injury caused by our negligence, for fraud, or in any other case where the law doesn’t allow it.
11. What we ask of you
- Install and use the pool as our guides describe — level, firm, prepared ground; the stated capacity; the stated water depth.
- Follow the pool safety rules that apply where you live. They are provincial in Quebec and municipal in much of the rest of the country, and they cover portable and inflatable pools. The legal duty is on you as the owner. Check with your municipality before you fill the pool — and in most cases before you install it, because a permit may be required.
- Supervise. Children have drowned in portable pools. Active adult supervision at all times, children within arm’s reach.
- Use any electrical equipment supplied with the pool according to its instructions and the electrical safety requirements that apply where you live.
12. Things neither of us controls
If something genuinely outside our reasonable control delays or prevents delivery — extreme weather, carrier failure, port disruption, and the like — we’ll tell you as soon as we can and agree a new timeframe with you, or refund you if you’d rather not wait. We don’t use this clause to keep your money.
13. Your personal information
How we handle your information — what we collect, what allows us to, who we share it with, how long we keep it and where it goes — is set out in our Privacy Policy. Cookies and similar technologies: Cookie Policy.
Two things worth knowing here. You have a Privacy Officer (responsable de la protection des renseignements personnels) you can write to — named, with contact details, in the Privacy Policy. And because we’re a French company, European data protection law applies to your information wherever you live, on top of the Canadian and Quebec rules.
14. Language / Langue
These terms exist in French, and the French version is available to you at any time: Conditions de vente.
If you’re in Quebec: Quebec law requires that a standard-form contract like this one be provided to you in French first. The French version is the one we give you, and you’re free to continue in English if that’s what you prefer. Choosing English doesn’t reduce anything you’re entitled to.
15. If we can’t sort it out
Talk to us first — contact@hippool.com, and we answer within 48 hours (Monday to Friday). Most things get fixed there.
If we can’t resolve it together, you can contact the consumer protection office of your province or territory, and, for misleading business practices, the Competition Bureau (federal).
16. Which law applies, and where you can take a claim
Whatever this section ends up saying, the consumer protection rights you have where you live apply. They cannot be displaced by a choice-of-law clause.
