In plain terms

  • Prices are in US dollars (USD) and include VAT. What you’re shown before you pay is what you pay.
  • You can cancel within fourteen days of receiving your order, without giving a reason — you pay the direct cost of sending it back. That’s your right under the Electronic Communications and Transactions Act.
  • If it’s faulty within six months, you choose: repair, replacement or refund — at our risk and expense (Consumer Protection Act).
  • Your Consumer Protection Act rights can’t be waived, and nothing in these terms tries to.

We’re a French company selling to customers in South Africa. We say it plainly. South African consumer law applies to what we sell you here, and we answer to it.

Also required and provided elsewhere on this site: a sufficient description of the goods and their main characteristics (product pages) · the full price including transport costs and taxes (§3) · manner of payment (§5) · these terms and the guarantees that apply (this page and Warranty) · dispatch and delivery timeframes, and our return, exchange and refund policy (Shipping & Returns) · how you can access and keep a record of your transaction (your order confirmation email, which you can save or print) · our security and privacy procedures (Privacy Policy · Cookie Policy) · your right to cancel (§7).


2. What these terms cover

These terms apply to every order you place through hippool.com as a consumer in South Africa. They form the agreement between you and BME Consulting, and they’re written to be read — if any part isn’t clear, ask us before you buy.

We may update these terms. The version that applies to your order is the one published when you placed it.


3. Prices, VAT and what you actually pay

  • Delivery cost is displayed before you pay. We don’t add costs at the last screen.
  • No customs, no import VAT to pay on delivery. Your pool is sent from stock we already hold in South Africa, imported and cleared through customs before you ordered it. You are not the importer, and nobody will hand you a bill at the door.

4. How your order becomes a contract

  1. You place your order — that’s your offer to buy, and the point at which payment is authorised.
  2. You receive an order acknowledgement email. Keep it: it’s your record of the transaction.
  3. The contract is formed when we send you a dispatch confirmation (or tell you we accept your order earlier).

We may decline an order if the product is unavailable, if we can’t deliver to your address, if payment isn’t authorised, or if the price or description was clearly and obviously wrong. If we decline, we tell you and refund you in full.


5. Paying

You can pay by card, with PayPal, or by bank transfer. Cards are processed through Shopify Payments. We don’t offer instalment or buy-now-pay-later plans. We never store your full card details.


6. Delivery, title and risk

  • We deliver to addresses in.
  • Your order is sent from stock we already hold in South Africa — not shipped to you from overseas after you order.
  • Delivery usually takes 5 to 7 days, to your home address. Delivery is charged, and the cost is shown before you pay. Detail: Shipping & Returns. Estimates given honestly.
  • The goods remain at our risk until you have accepted delivery — that’s your right under section 19 of the Consumer Protection Act, and we don’t try to shift it.

7. Cancelling within fourteen days

Under the Electronic Communications and Transactions Act 25 of 2002, because you bought online, you may cancel your order without giving a reason and without penalty.

You have fourteen days from the day you receive the goods. The Act’s standard window is seven days (section 44), and runs to fourteen days where an online supplier hasn’t made every piece of information the Act requires available on its website (section 43(6)) — fourteen days is the window we apply.

  • The only cost you carry is the direct cost of returning the goods to us. For a pool, that’s a large, heavy parcel — we say so plainly so you can weigh it before you decide.

8. If something’s wrong with your order

Your Consumer Protection Act rights apply in full — set out on our Warranty page. In short:

  • What we sell you must be safe, of good quality, in working order, free of defects, and durable for a reasonable time (s. 55).
  • If it fails, is unsafe or is defective within six months of delivery, you choose — repair, replacement or refund. At our risk and our expense (s. 56).
  • If a repair fails again within three months, we must replace or refund — not repair a second time.

9. Our responsibility, and its limits

Nothing in these terms waives, limits or excludes any right you have under the Consumer Protection Act. Any provision that would have that effect does not apply to you.

Subject to that:

  • We are responsible for loss or damage that is a reasonably foreseeable result of our breaking this contract or failing to use reasonable care and skill.
  • We are not responsible for loss caused by not following the setup, siting and care instructions we provide — in particular installing the pool on ground that isn’t level, firm and clear.
  • We do not limit our liability for death or personal injury caused by our negligence, for fraud, or in any other case where the law doesn’t allow it.

10. What we ask of you

  • Install and use the pool as our guides describe — level, firm, prepared ground.
  • Supervise. Drowning is a leading cause of accidental death among young children in South Africa. Active adult supervision at all times, children within arm’s reach.
  • Check your municipality’s rules on pool access and safety before you install. They differ from one municipality to the next. See Warranty — Pool safety in South Africa.
  • Check your municipality’s water restrictions before you fill. They vary by area, they change, and in some municipalities filling a pool is restricted or prohibited. This is your call to make with local information, and we’d rather you knew before you bought.

11. Things neither of us controls

If something genuinely outside our reasonable control delays or prevents delivery, we’ll tell you as soon as we can and agree a new timeframe with you, or refund you if you’d rather not wait.


12. Your personal information

How we handle your personal information — what we collect, our justification for processing it, who our operators are, how long we keep it and why it goes outside South Africa — is set out in our Privacy Policy, which also gives you the name and contact details of our Information Officer.

Two sets of law protect it: the Protection of Personal Information Act, and — because we’re established in France — European data protection law, which gives you a second set of rights and a second regulator. Cookies and tracking: Cookie Policy.


13. If we can’t sort it out

Talk to us first — contact@hippool.com, and we answer within 48 hours (Monday to Friday).

If we can’t resolve it together, you can refer the matter to the National Consumer Commission, or to the Consumer Goods and Services Ombud


14. Which law applies, and where you can take a claim

Whatever this section ends up saying, your Consumer Protection Act and ECTA rights apply.
